We wanted to give our community an overview of the two recently-passed bills, SB 1165 and SB 1138, and how they affect our Arizona community. Please see a summary of the bills below:
Summary of SB 1165: Only recognizes binary, biological sex (male and female only) of athletes K-collegiate Arizona interscholastic or intramural sports. Prohibits males from playing on female sports teams, and considers transgender women to be biologically male. Therefore, it prohibits transgender women from playing on any women's or girls sports teams in the state of Arizona, levels K-collegiate. The bill does not restrict any person from participating in sports teams designated as male sports. Bill lays the groundwork for schools to be sued for monetary damages if they allow transgender girls/women to participate in female sports. Summary of SB 1138: "A physician or other health care professional may not provide gender transition procedures to any individual who is under eighteen years of age. A physician or other health care professional may not refer an individual who is under eighteen years of age to any health care professional for gender transition procedures." Bill withholds public monies from any individual, entity or organization that provides gender transition procedures to any individual under eighteen years of age, and prohibits any state facility or employee from providing such services. Prohibits health insurance plans in Arizona from covering gender transition procedures for individuals under eighteen years of age. Bill lays the groundwork for individuals, family members, or the Arizona Attorney General to sue physicians and/or other health care professionals for violation of the contents of this statute.
